1. Acceptance of Terms

By accessing or using MemoryKeeper ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

MemoryKeeper is a private memory journal application that allows you to store photos, notes, voice recordings, locations, and other personal memories. You may create shared spaces with a partner.

3. Account Registration

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information when creating an account.
• One person may not maintain more than one free account.

4. Your Content

• You retain full ownership of all content you create within MemoryKeeper.
• We do not claim any ownership rights over your photos, notes, or other memories.
• You are solely responsible for the content you upload and share.
• You may export or delete your content at any time.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload content that infringes on the rights of others.
• Attempt to gain unauthorized access to other users' accounts or data.
• Use the Service to distribute spam, malware, or harmful content.
• Abuse or exploit the Service's features, including rate limits or storage.
• Reverse engineer or attempt to extract the source code of the Service.

6. Shared Spaces

When you invite a partner to a shared space:

• Both members will have access to all content within that space.
• Either member may add, edit, or delete content within the shared space.
• You should only share spaces with people you trust.
• We are not responsible for content shared within a space.

7. Paid Features

• MemoryKeeper offers premium features through one-time purchases or subscriptions.
• All payments are processed securely through our payment provider (Sell.app).
• Premium features are tied to your account and cannot be transferred.
• Refunds are handled in accordance with applicable law and our refund policy.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Service Availability

• We strive to keep the Service available 24/7 but do not guarantee uninterrupted access.
• We may perform maintenance or updates that temporarily affect availability.
• We are not liable for any data loss, though we implement regular backups.

10. Limitation of Liability

To the maximum extent permitted by law, MemoryKeeper shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

• You may delete your account at any time from the Settings page.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• Upon termination, your data will be deleted within 30 days.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law provisions.
